Anyone know about Detention Centres?

Hey everyone, i've only just joined the forum so a little bit lost...

My fiance is in a detention centre at the moment, following a prison sentence, and they are trying to deport him. They cannot deport him because of the country he is from and he has children from his past relationship, but they wont release him either.

What we are wondering is do you know if you are allowed to get married if they are in a detention centre?

The difference is we are not getting married the english way, we are not doing it so that he can stay or to let him keep his passport. We want to get married by his religion, so that when we go to his country, his family will accept me into the family.

Is this possible?

And also after returning voluntarily are you able to come back to england through marriage/spouse visa? He does not have a deportation order against him yet so am wondering if he can come back as we dont want to stay in his Home Country forever, only for a short time as it is not safe there but they wont release him here either.

Hi

i no th pain confusion tht ya goin thru,however wat was he in prison 4 bcoz it al depends on the intentions of hs crime and the length of time he done.which a sup is less than 12mnths bt mo than 12mnths is auto deport order for FNPs thou th HO will stil push to remove em.Having kids plays a roll if thy r british citizens and he can prove hs been in contact wit em al th way thru.VP cd b ideal bt being a FNP it m8 be a tricky one cz it may come wit a ban nt sure of th time length bt cd b up to 10yrs.Article 8 comes into play now, a suggest that u get a v gd solicitor get some cash ready as well cz if they find his claim clearly unfonded it wil b certified wit out of country appeal not gd, so he may need a JR wit an injunction from high court thts if hs claim hs got merits wit enough ties to the uk.its better to fight the case in the uk.

Many moons ago, when I did duties at Haslar, which was at that time run by the Prison Service, they did occasionally escort detainees to Fareham Registry office to get married.

I doubt whether the facilities would be available now for this. In any case you say you want a religious wedding, but you don't say which religion. All you can do is ask the management at the detention centre what is possible. I would have thought the easiest would be for your fiance to put in a request and find out that way.

You should take qualified legal advice as to your fiance's prospects of getting a settlement visa if he returns voluntarily to his own country. If he has actually been served with a Deportation Order signed by a Minister or the Head of UKBA, he will automatically be refused a visa until the DO is revoked. Without knowing the reason for his prison sentence it's impossible to say what his chances would be, but sometimes the quickest way to resolve a case is for the person to return to their own country and get a spouse visa.

I frankly don't know if you genuinely want to offer sound advice. It was extremely painful reading through your post.

Thank you for your reply.

It is a muslim wedding we want to have. He said he is going to speak to the Imam to find out if he will do it or not, his friend seems to think we will be allowed because it is only a religious ceremony, but i know what these places can be like.

He was given a 12 month sentence for an Affray charge. There has been no deportation order raised against him as of yet, he was detained at Brook House detention centre on 22nd October 2010 and we still have heard nothing from Home Office.

It does seem like Voluntary Return would be the easiest and quickest way before they try to raise a Deportation Order against him, i will contact our solicitor and see what the best option is.
