EEA1/2 Refusals – No Medical Insurance

Post by Braz » Wed Feb 09, 2011 6:29 pm

I wonder if there is someone in this Forum who may give us some help/advice with the following problem:
I am a EU citizen; my wife is Russian. We applied for Residence last October and on 5 February (last Saturday), the expiring date of my wife’s VISA, we received our Notices of Refusal on the grounds that we did not produce evidence of having a comprehensive health insurance for all family members. In fact I was unaware of that ‘Mea culpa’! According to these notices, though I am not obliged to leave the country, my wife will be ‘removed to Russian Federation’. As we are not going to appeal to court, I wonder if we could resolve this just sending them the insurance or must we start all over again with a new application? Yesterday I sent them copies received by mail proving that we already have a comprehensive medical insurance, saying that, as soon as we receive the original documents, we will send it to them. Is this enough or shall we be prepared for a visit of the authorities to pick up my wife?

Thanks. I hope not, I mean, that she will not be 'removed'. Yet, there is something I did not quite understand: whether I must reapply (like you said), i.e., to make a new application, or it will be enough to send them the document missing (medical insurance). The reason why I am asking this is simple: when I apply in October I had some savings and, as I am still looking for job, my finnancial capacity is much worse now. Hence, I am afraid that if I will do a new application they will refuse us again based on money reasons.
