HOW CAN I RETAIN RIGHTS TO STAY IN UK ?

Post by tasticg » Sat Feb 12, 2011 4:05 pm

I'm a Iranian mother of 4 children, three of my children are from my first marriage, age 24, 23, and 16 years old.
After my divorce I remarried with my second husband in Iran on 12-04-2001 and I gave birth to my a fourth child (boy )was born 17-08-2002 in Iran.

We lived together in Iran until my husband fled Iran on the 28-09-2006 to claim asylum in UK. He was granted refugee status in UK on the 12-12-2006.

I came to the UK with my daughter now 16 year daughter child from first marriage and my last child born 17-08-2002, my last son was about 5 years old and my daughter was 14 years old.

Me my 13 year old daughter and my son from my second marriage came to the UK to join my husband 12-12-2007, and we came based on settlement on basis of refugee family reunion under immigration rules 352A and 352D.

My 23 and 24 year old children were both soldiers in Iran and I went back to Iran after 1 month stay in UK with intention of coming back to UK my airplane ticket was return tickets and my aim was to come back to join my husband after 1 month in Iran after seeing my other children and make sure everything is okay, but was unable to come back to UK because I had my passport stolen by a money lender to whom I was indebted.
So I came to UK first time on the 12-12-2007, and went back to Iran 11-01-2008,
I have evidence and documents to prove that my passport was missing and it look a long time to get this matter resolved. When I went to the police i was informed I could not do anything until I paid my depth however even after I paid my depth I never got my passport back.
The man that stole my passport was my owner of the company I use to work for. As soon as I returned back to Iran on the 11-01-2008 the took my passport for about two years and I have also 7 witnesses from my work place that have sign statements and confirmed this matter. I have during this two years with difficulties gathered money to pay him back, and after I did he close down the company and is missing, police is still researching for him. I have with difficulties after I paid back the depth to the man ( I have resit I paid him back on the 30-01-2010.

With great difficulties and with the help of the Islamic Republic authorities and intervention of members of the parliament support I managed to get issues a new passport which was issued on the 02-05-2010, after my passport went missing.

UK ENTRY CLEARANCE ISSUED IN MY OLD MISSING PASSPORT:

In my old passport I was granted UK entry clearance valid from 31-10-2007 until 07-12-2011. The type of visa: VISA FAMILY REUNION to my husband. Straight under Type of Visa its written OBSRV: Leave to Enter until my husband ( his name is written) until 12-0... can not read the rest due to the stamp issued at Heathrow airport.

This entry clearance was suppose to be transferred into my new issued passport, however the transferred visa is not exactly the same, slightly different, details of the transferred visa is stated below.

UK ENTRY CLEARANCE ISSUED IN MY NEW PASSPORT:

Valid from: 25-10-2010
Valid until: 07-12-2011.
Number of Entries: MULTI
Type: D- To Complete stay which expires on the 07-12-2011.
OBSRV: No resources to public funds.

To end I'm still married and my husband has written a invitation letter to the British Embassy on the 21 July 2010, in which he is stating that he was aware of the missing passport and confirms that he was contact with us and his son, also that despite the long period of separation from me his wife, he confirmed that our relationship marriage is still subsisting and what we have intention to live together permanently.

To my stock when I finally came back to UK and stayed with him for about a month I found out that he had a g-friend and he trough us out from his out on the streets, we are currently married but live separately.

I would like to know how I can stay in UK once my Visa expires and if I can stay here because of my son in case he gets divorce from me?

PLEASE HELP ME URGENTLY
Also could you email me free immigration lawyers details to help present my case to home office, I live in London. But I have no money to support myself to get a solicitor is a free help available? Can you advise me if I can stay here based on article 8 and my son?
I know that my husband can apply for indefinite leave to remain after 5 years of his stay in UK which will be after 07-12-2011, he can apply or ILR,
if we are still married will I be granted that ILR automatically as well please help me find a way to stay here and be with my son, I do love my husband despite all and wish we can live together but he is not interested because his new G-Friend I am just praying to God he returns.
I can not live apart from my son, which he is attempting to get custody over and got the social services involved into my life just tries to make everything difficult. Despite the intervention of social services nothing has been found to say I am not a good mother, I love all my children and do what ever I can to satisfy all their needs and give them the love attention they all deserve. God bless you help me urgently

sincerely yours from a
brokenhearted wife and mother.
