Settlement after 4 years of marriage

Settlement after 4 years of marriage

Hi there

The reason I am in here posting this is that I have immigration issue to find answer to, and I hope that with your help I can at least start to resolve it. I can say that this site provides so much information, credits to administrators.
Anyhow, here is my situation:
1. I am a British citizen living and working abroad for a private company

2. I am married for the past four year to a Kosovar and we have 2 children together.

3. During oor marriage I had to trevel with work around the EU what means, we were not living together for the full four years. Do we have to be living for the entire 4 years together?

4. Places that we lived did not allow us to out any bills on our names. Do es it make it any more difficult?

5. We have savings of about 25k euros and good professions, she is a MRSc of Pharmacy, while I have a MBA degree. Does it mean that we have do find jobs before moving or move in UK and find jobs?

6. We are plannig to move to UK sometime in autumn and I have no property to move on to which means, either we rent, or move with someone that has space for us until we find our suitable accomodation

7. I have read some time ago that after 4 years of living together a married couple can apply straight for Indefinite leave to reamin. Is this still the case? If so, was there a case in here in which I can refere and get advoce as to how it all went.

Hope to hear for some advice.

Yes, if you are hoping for ILE (explained at the end of post).
Short absences due to work-related assignments can be explained but if you weren't together, let's say for months in-between, it can be a problem.

Yes, if you do not have other documentary evidence(s) of living together.

Having a job / offer is good, but not a necessity.

You will have to provide evidence that you meed the Maintenance and accommodation requirements.

If you married at least 4 years ago and have been living together outside the UK for at least 4 years, then your family may be eligible for Indefinite Leave to Enter (ILE, similar to ILR).
If you are currently outside the UK wrote:We may be able to give you permission to live permanently in the UK as soon as you arrive, if:
  • you and your partner married or formed a civil partnership at least four years ago;
    you have spent those four years living together outside the UK;
    you are both coming to the UK to settle here together; and
    you have sufficient knowledge of the English language and life in the UK. (You do not need to meet this last requirement if you are aged 65 or over.)
