Apply for new FP with existing one while waiting for EEA2?

Hi!

I hope to get some help here as the UKBA was not really able to assist me.

My wife has been granted a FP back in October 2010 which will be expiring in mid April. She is currently living with me in London and we applied for the PR via EEA2 on Feb 17, which was received by the UKBA on Feb 18.
When I called two days ago they had not yet assigned a HO reference number and reading through various posts this does not seem unusual.

However, as we have a trip to the States scheduled for Easter (after her FP expired) we will need her passport along with the issued PR in order to apply for any foreign visa (3 month visa rule, as her exisiting FP will expire even before the trip).

Given what I read it seems impossible to hope for the PR to be issued on time to get the US visa issued as well. Furthermore, my wife would like to travel abroad to both visit her own family and for elections in June and to visit my family in the next few months. But without a PR she cannot re-enter the UK.

As we really want to avoid being stuck here for 5-6 month without the possibility to travel, I was thinking of requesting a return of the passport, sending her home for a family visit asap and then re-applying for a new Family Permit abroad. I believe this way she can re-enter the UK and have the flexibility to travel while her EEA2 application is stuck in the queue to get processed.

My question basically is whether it is possible for her to go home to Turkey as soon as she has a HO Ref and then apply for a new FP (while the existing one is still valid till mid April). Thus having a visa for the UK that is valid more than 3 months and we could then apply for the US visa and a Schengen visa for the remainder of the time till the PR gets issued.

Anybody aware if this could work or is it not possible to apply for a new FP while the current one is still valid?

Any help/advise is greatly appreciated!

renewing existing family permit?

Does anybody know at all if it is possible to apply for a new family permit while the existing one is still valid?

We have our reference number by now but have been told to wait for another 4-5 months. As this won't work with our summer plans at all we want to request a return of the passports now. However, I was still not able to verify if it is possible to sort of renew/extend our current family permit.

Any help is greatly appreciated!

Your post is quite confusing. You say you have applied for 'PR' on form EEA2 but that would actually require EEA4. You do not mention your wife's nationality. If she is a non-visa national travelling and entering without a FP (technically not a visa) is possible. Schengen visa may only be issued to residents, i.e. the embassy may expect to see a (permanent) residence card.

My wife is a Turkish national, I am German and we did apply for EEA2.
Not sure about the exact terminology of what will result out of that, think it is called residence permit and valid for 5 years under directive 2004/38/EC and not PR, sorry for any confusion.

We are still having the same dilemma. We have not yet received the COA and I am not sure if I should recall the passports or hope for a miracle.

Would you happen to know if we could apply for a new Family Permit while her current one is still valid, basically arguing that we would need one in order to allow home visits after her current one expires and before EEA2 has been completed. Think writing an explaining letter along with the application might help if the case worker has any room for judgement calls. I am more worried that there might be a legal rule preventing him from even considering issuing a new one while existing one still valid.

Any idea?

Hi. I dont think you will be able to apply for another FP while the first one is still valid. I am actually stuck with the same situation as you, i travel often for work and right now waiting for my passport to come back with EEA2 and the FP is expired. Now in this case, what you can do is, wait for the FP to expire and then go to Turkey before or after coming from US and get the second FP to enter in the UK as it will be valid for another six months.
Now in this case, you wont have much proofs with you as you might have submitted your documents for EEA2 so i suppose COA will and should do that alongwith photocopies of the relevant documents. DO share the experience what you did and how it went, as i might need to do the same.
