You must join your next course within one-month otherwise you wont be able to extend your visa in Sep'11.

If you will travel to your home country without enrolling any other course your entry may be (90% chances) refused when you return as the course has been finished for which you got your visa.

For MBA Sep'11 intake, you need to apply from your home country again for entry clearance.

You can work till your visa is valid.

Dependent application is most likely to be refused as you have finished your course. Even they wont let you enter (90% chance) if you travel to your home country.

Why do you have so much leave left after the end of your course? Did it finish earlier than expected?

Students applying from inside the UK
If a student is already in the United Kingdom and his/her existing permission to stay runs 80. out more than one month before the start-date of his/her proposed next course of study, he/she will be expected to return overseas and apply from outside the United Kingdom. If the applicant applies from inside the United Kingdom, his/her application will be refused. A month will be considered a calendar month (for example, if an applicant’s leave expires on 14 January his/her new course must start no later than 13 February).
We suggest that if a student’s course has ended and he/she is applying from inside the 81. United Kingdom to extend his/her stay, he/she should apply in the last three months of his/her permission to stay if possible. This is because as soon as we give permission to stay (if the application is approved), the student’s new Tier 4 sponsor becomes responsible for them.

I presume you have posted this in response to kkj's post?

Not sure what you are trying to say exactly. KKj is incorrect about having to apply for your new course within the next month. The month rule relates to not being able to extend in country if the new course starts more than one month after your current leave expires

However it does not seem correct that you have so much leave left following the end of your course and I think kkj is correct that you may have difficulties bringing your dependent over given that you course has now finished. You also may have problems re-entering the country as he says.

I do not think it is advisable for you to be in the UK working and not studying for 8 months on a Tier 4 visa.

If you answer my question above then it is easier to advise you.

I understood your question but you have not answered mine so it is difficult to give you accurate advice.

The maximum time you should have on your visa after your course is finished is 4 months (if the course is more than 12 months long). Why do you have 8 months left on your visa when your course has now finished? Did your course finish earlier than expected?

Actually he must have applied for longer course but join shorter course in the same college. Thats why I suggest him to join another course within a month otherwise it will be difficult to awnser at the time of visa extension that why he done that and what he was doing in last 8 months.

Hi, I have a similar question.

My course finishes, as planned, in July 1st. My visa expires on September 30th. I want to re-enrol and to study the next level at the college, so I was planning to take 2 months holiday or so over the summer and stay in London, and then restart studying in August or September, and therefore extend my visa in the Croydon offices sometime in July.

For the 1month rule, does that apply to the end of the visa OR the end of the course? - Is it necessary for me to restart studying within 1 month of my old course finishing?.

Returning to my home country is not really an option, so if its necessary, I will abandon any thoughts of a London summer holiday and just continue studying within 1 month of finishing my original course.

(My college has start dates around the year)

As long as the course doesn't start more than one month after your leave expires, you can apply to extend your visa from within the UK.

Well it depends whether you are "Tier4" visa holder or "student" visa holder??
Have you got BRP?
Even in "Tier4" visa, if you applied after 5th Oct 2009(I'm not sure of date but it is some time in Oct 2009), you are under different visa condition's.

If you are allowed to apply in Sep, you have to show 9 months maint. fund.

Can you pls kindly explain in normal language of these 3 points.

Do you have an 'established presence'?

Any student (including a postgraduate doctor or a student union sabbatical officer) has an established presence studying in the UK if they:

*
completed a single course of study lasting at least 6 months during their most recent permission to stay in the UK, which ended no more than 4 months before their current Tier 4 application; or
*
are currently studying a single course in the UK, of which they have completed at least 6 months; or
*
are currently studying in the UK, and have completed a single course lasting at least 6 months during their current permission to stay.
