hi there, i am new in this forum please forgive me if the way i put my question is somehow confusing and help as you can.

I have eea residence card for family member of eea citizen which i have received on the basis of durable relationship with my eea partner for more 3 years and 11 month on feb 2011. I also have tier 1 psw visa which is valid until November 2011. my eea partner will complete her 5 years while exercising her treaty right so will be automatically qualified for pr and since according to uk law i got to know that the family right will start only from feb 2011 so i have to wait for pr until 2016.

So my question is can i switch back to my tier 1 psw visa before it expires and apply according to uk law as my partner will be settled in few months time?

is the tier 1 visa cancelled as i have now eea residence card ? if yes why because if uk law dont consider my previous 3year and 11months with my partner and starts the family status after issue date of residence card according to EEA law than this means my psw visa should still be valid until nov 2011 and i should be allowed to visa issued according to uk immigration law.

Why on earth do you want to mess up things? Leave it alone and live happily together with your partner!

What is the problem to wait until 2016 for PR? The Residence Card that you have already gives you all practical privileges (to live and work in the UK without any restrictions) that you need. Permanent Residence sounds nice but doesn't add that much: the only practical advantage that I can come up with is that it allows you to split with your partner without negative effects on your immigration status.

Your Tier 1 (PSW) is no longer valid.

i dont know where is your information from i called home office and asked them they told me its still valid under uk immigration but its confusing and asked me why do i ask?
