Tier 2 + British baby

Post by scarfie » Thu Mar 17, 2011 12:24 pm

Hello there. I hope someone can help here - it's a rather complicated situation. My fiancee and I have had our first child - she's Indian and I'm British, and our daughter now has a British passport.
My fiancee has been in the UK for 6 years - 2 on one employer-sponsored work permit, 4 on another, and can apply for indefinite leave at the end of this year.
She would like to be able to work part-time so that she can look after our daughter more, but has been told that she can only work full-time.
Is this true? Is there no way around this because her commute is huge, the nursery fees are massive and surely if you have a baby, the situation changes?
Any advice would be appreciated :)
All the best

I can't think of any visa which only allows you to work full time and not part time. What visa is she currently on?

tier 2 can only be issued for a job with atleast 30 hrs per week...

if she can no longer work atleast 30 hrs per week, then she doesnt satisfy the visa requirement!

maybe change her status to dependednt??? but it could have some effect on ILR so you better study the laws carefully before deciding on that
