Possibilty of a rejected settlement visa

My wife is stuck in New York awaiting the outcome of her settment visa. We are both scared that this could lead to a rejection due to a DWI in the States in 2009. The consulate required a further piece of paper and instead of the 3-4 days expidited priority service we paid for this could take up to 15 working days or longer to hear the outcome. What are the chances of rejection? If it does fail we will appeal and I know lawyers are very expensive in such matters, but how much and how long does the process take? Has anyone had similar experiences?
