overstaying while applying for hsmp

I applied for HSMP in the beginning of March and unfortunately it got refused. My visa got expired on 2nd of april and my application for leave to remain in UK was also sent back to me which i received on 06th april. I would like to know if I am overstaying or not as the home office letter says that i can get my application reviewed in 28 days. My application for HSMP was refused on 31st of march 2006.

Hi,

I understand totally your concerns. I was in the same position. Did you get the visa cancelled by the HO upon the return of your passport? I was told the section 3C applies for cases like this. But I am not very sure how it plays a part. It is ideal to write to the IND case worker and tell her your situation. I was given contradicting advice by the Croydon and Sheffield office. It will be best to hear others views on this.
