waiting for work permit application

My US based company had applied for me for a work permit at Home Office . Now I'm in the process of waiting for my work permit application. last week, they requested additional documentation based on setion 36 below : reference letters for last 5 years relevant my working experience.


The position is in IT and requires 5 years experience. I have 12 experiences in IT field doing the same job, even have work in the past with same company in USA for 3 years.
In last 5 years, I worked with 5 firms as consultant or perm from 4,6,8 months to 1.5 years. Now, I did send three references for year 2006,2005, and 2001.

Do I really need to get a reference for each project ?
I do hope to get some feedback and your experiences with WP?
Is Home office really qualified to understand my skills and expereinces ?

Section 36
36. Please send references from past employers on their headed notepaper that verify the person's relevant work experience. They must give the start and finish dates, details of the work and any experience that makes the person qualified to do the job. If they are not in English please send a translation. References that only describe the person to be of good character are not appropriate. (see also Section 4). We may also request evidence of the establishment overseas where the person
gained their work experience.

No one doubts you are capable of doing the job, but there is also the factor that in order to get a WP for someone the employer needs to show that it is impossible to fill the vacancy from within the UK or elsewhere in the EEA.

If the application for WP gets rejected, do you qualify for HSMP? If you got that it would give you freedom to work for anyone without needing a WP.

The company did already the advertisements process, the problem is with the references section 36. In every CV we put the start and finish dates, details of the work and experience and HR contact information. They can just pick the phone and start calling HR dept and find out.
"References that only describe the person to be of good character are not appropriate " is just wasting poeple time and effort.

Congratulations on getting the WP. Now of course you need to get an Employment visa to enable you to move to the UK and use that WP.

It is recommended that you apply online using the facility at www.BritainUSA.com .
