HM Forces Spouse ILR (not living together)

Post by Jarrowlad67 » Thu Jun 30, 2011 11:41 am

Hi,
I have read many Gov websites and I can still not get a definite answer to my questions, I have also emailed the UKBA and Visa agency and neither seem to be able to help, they just pass me back and fro.

I am a serving member of HM Forces (since 1997), I have been overseas since Feb 2010 on a 3 year unaccompanied posting, I was married in Thailand in May 2010 to a Thai National. After we have been married 2 years can I apply for my wife to have an ILR visa or do i need a apply for a LTE visa first? It seems crazy if I need a LTE only to be immediately applying for ILR basically at the same time. My wife is exempt the UK knowledge test due to myself being exempt immigration control and I am lead to believe THAT due to me serving overseas on an unaccompanied posting that it is classed as if we were living together in UK?

your help please

SM.
