Tier 1 General: Early Application Issue ???

Post by Tirma » Mon Jul 04, 2011 2:59 am

My initial Tier 1 General visa expires on April 2013. After November 2012, I won't get my 5 points for age.

If I apply before November, there will be 6 months short in ILR application.

What should be done in this case?

You all are welcome for good suggestion and hot discussion.

Cheers!

Sush,

I followed your link and read through but there is no clear answer for my question. So, I'm writing further in detail. Thank you for your patience.

I got 5 point for my age 39 when I applied intial Tier 1 General on 10 Oct 2010. I became 40 on Nov 2010.

After 6 months (April 2011), I got initial Tier 1 General which will expire on April 2013.

If I apply for my extension after Nov 2012, my age will be 42 and I guess I won't get 5 points for age.

If I apply before Nov 2012, I will have 6 months short for ILR application.

What should I do in this case ???

Sush and experienced people are welcome to share and answer my question. Thank you very much.

Hi Tirma,

The age you specify at extension is not the current age, but the age at the time of first grant. If you were 39 when you first obtained your Tier1 and claimed 5 points, then at the time of extension you will provide the age 39 (and not 42) and still claim 5 points. If you see the extension application form (page 30), you can find this text "age at the date of application for the first grant of leave in the category".

Hope this is clear now.
