Appt at French Embassy and UK SOLVIT

Post by SRAQAI » Fri Jul 15, 2011 12:44 pm

I have just realized that the woman who 'administers' the UK SOLVIT actually works against your case, rather then help you! This is unbelievable! My husband has his second appointment for his second attempt to a schengan visa at the end of the month (the french embassy, reminded me to tell my husband to bring the required documents!) and i called the SOLVIT to check an update on our case. She said that she has notified the french SOLVIT that our Pakistan marriage certificate is not valid, because it wasn't issued by an EU member state! Instead of helping our issue, she is making it even harder for my husband to get his visa. Apparently, a Pakistan marriage certificate, because it is not attested by an EU state, or issued by an EU state, is invalid! Am absolutely livid!

My husband is going to go to the interview, armed with a 3 page letter from my casework (in french!) outlining that they can take this case of ours to cpurt, if the french officials do not fulfill our rights and he also outlined where in EU and national legistlation, it states that my husband is entitled to a Schengan visa as a spouse og an EU citizen. I am hoping this will do the trick. Nevertheless, even though we technically do not have to supply these documents, I am going to send my husbands travel itinerary and hotel details - but they are not getting bank statements or the last 3 months, which I dont have and am not about to run around like a headless chicken, getting statements from my bank, especially sonce we do not require any of this under the 2004/38 directive.

How can UK SOLVIT DO THIS?? :( she said that Pakistan has to be 'signatory' to The Hague in order for certificate to be valid! He is my husband, for crying out loud!

No, they do not have to be a signatory. If they were it would just make it simpler for you because all you had to do was to get the Hague Apostille on your marriage certificate. The point of the Hague convention is to make certification of documents (for legal purposes) simpler.

But as they are obviously not a signatory you will have to go through a longer 'chain of certification'. I am sure someone else here knows how to do this, certainly in the 'Immigration for family members forum'.

Yeah your right: Pakistan is a commonwealth country and the EU recognizes commonwealth. Im just trying to find a link that 'proves' this, so i can show this dumb nut head of a SOLVIT person
