Help on Switching from PSW to Tier 2

Hi,

I am currently on PSW visa with still over a year validity left. I was selected for an interview in a grad scheme which lasts 2 years. But now, they cancelled it because my psw visa will expire before the scheme duration.

I can see the company listed under this list

Would it not be easy for them to sponsor me once I have worked with them for a year with a salary of £25000. They argue that for my role it would be difficult for them to prove that no one in EU can match my skill set. But will the company really have to prove this to ukba on my visa status? I understand this is not the case for migrating from psw to tier 2.

They will consider me again if I can point out the exact rules to them. Is there anything on ukba that I can forward to them? Please help me in structuring a reply. Thanks a lot

As long as you are able to show UKBA that you have worked for the employer for ATLEAST 6 months prior to applying for a Tier 2, your company doesnt need to do any RMLT - Resident Labout Market Test.

So, take prints of the Tier 2 Policy Guidance and show them to the employer - where this is clearly mentioned.

You will however need to fulfil all other requirements for Tier 2 of course.
