moving to other EU country and visa

Hello.... i wonder if anyone can help.
iam in a 2 year pobation marriage visa(iav from latinamerica)... i have been having problems with my husband and thinking in move to study german in germany, and leave my husband... but can i apply from here for the german visa? would afect the fact that if i apply it would be cause we have decide to separate (my husband and i). would afect if someone else in germany would be my sponsor...

other thing... if we decide to stay together and i got my settlement visa (wich ill have to appply in jan), would afect if i decide later after i get the visa, to separate????? would i have to return to my country?

This situation is had for me cause i love alot my husband but i have been suffer of verbal abuse and at moments he is fine and other he is not, so im not sure of my future... plus i have already make i life here(work, friends) it would be hard to go back to my country and star from cero! please some help me... what are my options...
