Family Visa got refused, Need your Help please

Post by qureshi123 » Thu Aug 18, 2011 1:19 am

Hello All,
I am not sure if this is the right space to write this type of post. If not please accept my apologies.
To start with Let me give you quick background of this application.

1) Reason for visit to UK=
My father (59), sister(21) and brother (17) wanted to attend my wedding on 3rd of aug 2011 and applied for family visit visa,They also mentioned they are going to visit my brother and his family (2 new born)

2) My father is self employed registered contractor in pakistan but work very little to earn enough every month around (50,000 PKR) as he owns the house and doesn't have to pay rent. My sister is studying and so does the brother.

3) My father works and get cash in hand and which he deposits every month in bank so he has not receipts or proof of this 50,000 pkr( as this is common thing in pk to do cash transactions.

4) Now he has been refused on the basis mentioned below

'' I am not satisfied that you are in business as claimed because you have failed to produce sufficient evidence that such a business exit and are involved in it or any evidence of any regular income from deriving from such concern. your stated income is not reflected in your bank statement which shows large deposits in excess of your income. you haven't indicated receiving any income from any other sources to which i can attribute these funds.I note the balance of funds fluctuates greatly throughout the accounting period covered. So therefor i am not satisfied this bank statement is an accurate reflection of your personal and financial circumstances. Nor am i satisfied that you have genuine intention to enter uk and leave as a visitor.''

So this is the reason he got refused and same reason applied to my sis and my brother as they both were dependent of my father.

Now, we have the proof that where the big 3 deposit came from in his bank account. 1st one of 3 million pkr which is from the sale of his house in different city, we got the sale receipts of this in english verified, 2nd and 3rd deposits are of 300,000 in 2 months which was the money owed by his brother gave him back for this visit. A letter from the brother can be obtained.

Appeal must be lodged by 24th of this month. I need your prompt advice on this occasion. Any piece of advice will be highly appreciated.
thanks

You have little choice other than to appeal. The ECO has arbitrarily considered that your family do not have sufficient ties and resources to their homeland to motivate their return. On balance this decision is probably less about the resources and more about the ties. New applications will likely be greeted with the same decision again. You can't change their circumstances (assuming they were honesty stated in the application) so you'll have to appeal and leave it to a judge to decide whether or not he agrees with the ECO that they represent a non-return risk.

Depositing large sums of money prior to an application without substantive proof of where that money has come from always end up in a refusal, just like your family's.

Personally I would lodge an a fresh application with clear proof and explanation where the money has come from, rather than appeal against decision which is time consuming and costs can far outweigh the cost of a new application.

I can tell you now i applied for same visa ( 3 people ) and same reason ( wedding).
Took me more than a year to get visa. They are very strict.
I will post my experience soon.

Good luck indeed.

Hello to all,
as I mentioned previously my family visit visa got refused on the basis of my dad's financial situation and I made an appeal against HO refusal and recently we had to attend the hearing in wales at one of their immigration tribunal, I appeared as co sponsor and judge heard my valid points and based on that he allowed our appeal and just yesterday my father back home(Pakistan) received the decision letter of tribunal. Now what I want to know is what will happen NEXT?
Is UK embassy in abu dhahbi going to write a letter to my family to submit their passports?
OR
to submit fresh application?
OR
My family need to contact Abu dhahbi embassy himself?
or it is something else?
I would appreciate your swift response. Thanks

Yes. It could take as long as 8 weeks.
