New born eligible for British passport, but ...

Post by webhunter » Tue Aug 30, 2011 5:44 pm

hi,

My child is eligible for British passport on the grounds that I am PR(ILR) at the time of her birth.

However, since I have plans of leaving this country in a couple of years or so, can I now apply for an Indian passport and still have the flexibility to change it to a british passport if the child wishes to do so when she grows up?

Also, I was wondering what is the best way for her to travel between India/UK for the duration of our stay in UK. I don't think they will give ILR, because I (parent) is already on ILR. So is 'Right of Adobe' the only option available for her to come back to UK ? and can such an application (Right of Adobe) be made from India?

Thanks in advance.

Your born-in-the-UK child was British from the moment of birth. As India does not permit dual nationality, surely it follows that the child cannot get an Indian passport?

Yes.
Passports for Children born in the UK wrote:11. In case more than one year has elapsed since the birth of child or one of the parents hold British nationality, then a letter from the British Home Office stating that the child has not acquired British nationality would be required.

12. Beside, an affidavit from parents that the child has not acquired British Nationality is also required to be filed at the High Commission;
