Workpermit to Tier 2 Transfer

Hi,

I have a five year work permit since January 2008 and I can apply for ILR after December 2012. Please correct me if I am wrong.

After spending 3 and half year (approx) I want to change my company. The new company will apply for Tier 2 for me. My question is if I change my status from Work permit to Tier 2 will I still be eligible for ILR after December 2012 i.e. 3 and half years I spent on Work permit will be counted or do I have to spend five year after getting the Tier 2 visa again?

If Tier 1 (General), then 245HF(c) applies.
