supplementary employment

Post by bjbatra » Fri Sep 23, 2011 5:34 pm

I understand that as a Tier 2 (General) holder, "supplementary employment" is allowed subject to a few conditions including, "as long as it is ...in the same profession and at the same professional level as the work for which your Certificate of Sponsorship was issued".

1. Where can I can get details about what is included/ excluded in "same profession" and "at the same professional level"?

2. On a related point, could I take up "supplementary employment" as a consultant (self employed) or would I need to be an employee of the second place as well.

Would be grateful for some advice.

1. In the same profession and at the same professional level as the work for which your Certificate of Sponsorship was issued. So I suggest you refer to your COS to see what it is that you do and at what level and then one may assume that any other position that does not exactly match that is not permitted.

2. Self-employment is not permitted.

Thanks Lukapooka,

My CoS classifcation is "3539: Business and related associate professionals not elsewhere classified". Rather vague and unhelpful, unfortunately. Anyway, I shall try and figure it out.

Thanks for the info about self-employment. Is there a source for this?

I am aware that this is considered a general bar, but curious since there is a reference to self-employment in Para 448 of the Sponsors Tier 2 Guide

For supplementary employment you are looking in the wrong guidance. What does your sponsor say that it is you do for them? Or are you only referred to by colleagues as that guy (name), who works here but we have no clue what he is actually doing for us? Is there a job title?
