muslim divorce or uk divorce

Post by immiweb » Wed Sep 28, 2011 7:02 pm

Hi, I'm new to the site. Hope someone can help please.
My friend had a nikaah in pakistan & his wife & son came to live in the uk. They later divorced by muslim talaq (divorce). What I would like to know is, does immigration accept this divorce or would he have to have a british divorce. They did not have a civil marriage here in the uk. Also, if he was to remarry & need a visa for his wife, would they have problems. Many thanks.

If the marriage in Pakistan was considered to be legal under UK law (which appears to be the case), a religious Talaq won't be legally recognised here. The couple will have to divorce through the UK courts if the husband wishes to re-marry and apply for his new wife to settle in the UK.
