Hi friends,
my name is yuvan from UK ..im in PSW (Post study work ) Expires in 06/03/2012 ..last month 10/10/2011 i got a job in ABC company as a software tester in LONDON ...im scarying about my visa expires next 5 months still im not asking anything about sponsership to my company, so can you please provide me full details how to switch over PSW to TIER2 (company work permit) what type of documents i need and how much amount i need to maintain in every month ... mainly what type documents i have to ask my Company management....

3. £20,000 gross salary.

in the above 3 ,
i have 23k salary but i joined in Company 10/10/2011 my visa expires 06/03/2012 i have only 4months 25days only so how can i eligible for 2 option like atleast 6 months employed by the same employer.....what can i do..im so worrying abt 2nd option is any other option .....
and 1 option is k i will ask my employer to provide COS....

so pls friends give me some valuable suggestions pls

Hi yuvancse,

1) You need to have worked 6 months with a current employer

OR

2) the job must be in the shortage occupancies list

OR

3) employer conducts a resident labour market test for you and proove it to UKBA that he was not able to find any settled worker to do the job and hence he wants to employ you.

OR

4) Your salary is above £150,000


Then only can a Certificate of Sponsorship be issued.


The way forward for you should be to realistically discuss this with HR department within your company and see what they say. If they like your work and treasure you as an employee I'm sure they would be able to figure something out. But whatever the case may be, you should do it asap and waste no time.

With just 5 months in hand it will be a very close call, But if you start like now you might have a chance. Given, you satisfy the requirements.

Your company has to do a resident labour market test if you're not working for them for the last 6 months.

Do check the SOC for your job title and see if you satisfy the salary requirements. 20K is the minimum but most of the jobs are a lot more than that.

But I still feel you're too late (Cause company registration is not a very easy process, A tiny mistake will cause a rejection and loss of precious time in your case. I recommend you get your HR people involved and start like right now, If your company IS registered and has a A rating then its a matter of doing a RLMT and request a COS)

£20,000 is the absolute minimum requirement, however your salary requirement may be higher depending on your job title and what it says in the code of practice for your job.

1) my Basic salary is 23k and with benfits 25k

2) my company in the list of "A" Rating

3) my Job tittle is "IMPLEMENTATION CONSULTENT GRADE -2"

Recently i mean last month 10/oct/2011 i joined so im scarying ask with in a short time ...

1) i need to ask my manager or HR people
2) can u pls tell me clearly what steps i need to start immediatly friends
3) im totally confuse with COS...im totally new to this feild

i dont know anythng abt COS and tier 2 so pls guys if u dont mind clearly tell me
wat steps i need to do now....which deptartment people i need to met and what i need to explain ....
so these details pls tell me...i will start ASAP

I think you should start by reading the official guidelines,

Download Tier2 guidelines and read ! It will help you with the basics, Once you understand how it works you can approach your employer. Have your employer checked your visa status before hiring you ? Did you speak to them about it at least ? Why are you scared (Its scared not scarying) to ask them ?

Now, First things first, Speak to your Manager and Director if needed. Explain them the situation and see what they say. If they think you're worth sponsoring they will put you through to HR.

Also your English is just awful.

Reason For scarying to ask COS for Employer

Hi friends,

i joined my company in 10/oct/2011 at that time they ask me ur visa is going to expire next march so when do you extend and how to extend at that time i gave answer like its extendable visa once extend my visa i will re submit that one....yboz first day if i say like u need to sponser me work permit visa , so i dont know how they will react so i will tell like that....but now im planning to tell my situation but still im confusing just one month i completed if i tell now or can i take another 1 or 2 months like end of december ....
just tell me friends can i apporach now or can i take some more time to ask my COS ..my visa is going to expire 06/march/2010 ......

Yuvan so you purposely lied to your employer stating your visa can be extended but in fact there are no ways to extend PSW and given TIER1 general already closed.

Now you're scared that your employer might not give you a sponsorship ?

Didn't they check your passport and how much time you have in your visa before hiring you ? Every company must keep a record of all the immigrant works, FYI

Like many others pointed out you have to speak to your employer about this. Not us ? It's always best to prepare a bit early, You don't want to wait till the last minute.

im not purposly lied ....when i did interview time they didnt ask me abt visa status after i got job and i joined company 10days duration time also their in that mean time they collect all my documents including visa copy as well but they didnt ask anythng abt at that time.....after i joined few days later they ask me at that time i gave that answer ...anyway i will ask ASAP.

ok friends thanks for everybody who gave me useful information in my post, so finally i came to one idea..

2nd option :

my job tittle is "IMPLEMENTATION CONSULTANT GRADE - 2" i seen shortage application list but i didnt find this job tittle ....
so can you pls tell me friends my job tittle is eligible for tier 2

3rd option :
Resident Labour test
so im confuse friends if i prefer Resident Labour test ...wat is the process of complete that one...

when i need to contact my manager ...

1. find a job title - first and foremost. If its not there choose the next best job title. Make sure your employer agrees with it.
2. If that job is mentioned in shortage list, then you are exempted from RLMT.
3. If its not there, but present in code of practice, then your employer must conduct RLMT.
4.If your job doesn't exist in shortage list OR code of practice... you are screwed! i.e. you dont satisfy tier 2 requirements.
5. Ensure that you are paid 'appropriate salary' for the job title you have chosen. Make sure to pro-rate your actual salary to 37.5 hours to find out if its higher or lower the requirement mentioned in code of practice/shortage list.

PS. if you are currently working for same employer on psw for 6 months, then you are EXEMPTED from RLMT, by default

the problem is im just joined 10/10/2011 ...i completed just 1 month only my visa expires 06/march/2012

How can you say you can try option #2 ? Your job MUST BE in shortage occupation list. You can't make up something..

When you say you're a Implementation consultant does this falls under Software category ? Explain your job duties/responsibilities/sector so we can have a look at the SOC for a matching job title for you. (What kind of consultant cant even spell "consultant" properly? :? )

Resident Labour test is advertising your job in websites etc, Again follow the URL I provided for more information. Most likely your company already know this process.

As far as I'm concerned your only option is to convince your employer to conduct a RLMT and provide you with a COS.

excuse me i know my words and i know how to spell here no body asking you abt my english grammer ok, so many people through out world they dont know even how to book train ticket in online but they are writing java code ,etc. and they are doing so many things ok ..so

if you like just give good suggestions who really needed urgent help, dont blame them ok,

I don't mean to be rude to you but you kept ignoring all the advise given. Even though we posted many replies to you with relevant information you still don't want to take some time and read anything ? If you're so busy do you think we have the time to sit here and spoon feed you everything ? You're the one in trouble not us. So, I suggest you make up some time reading and working towards your visa.

No if you make spelling mistakes in java the program wont work FYI.

I just notice the COS after submitted my application.
However, I start to worry about my visa application. Hopefully someone can give valuable answer to me. thanks in advance.

I submitted my application on 26 Oct 2011. After I'd received biometric invitation letter, I took biometric on 16 Nov 2011. I have not heard anything from UKBA so far.

my job title is marketing assistant and the salary is 20,000. I have been working in the same company for over 1 year.

My company and I were naively thought that we only need to reach at 20,000 annual salary and didnot notice COS rule.

In my situation, will my application be withdrew?

Hi, it seems to me you have no choice but have to tell your situation to your employer.

You still have a little time before expiring your visa, so I may suggest that

1. research visa situation of your company

I do believe you have some colleagues who work in tier 2 visa, so you can get some information from them, such as how much supportive your employer are for tier 2 visa, how they conduct the Resident Labour Market Test, and etc.


2. check the shortage occupancies list

You should check it by yourself. If you find it, you will take an advantage of it. If not, you may be able to pick up some occupations which is similar to your job title. You need to keep them in your mind, because you may need them when you discuss your tier 2 visa with your employer in order to avoid the RLMT. I believe it is just a job title, and basically who cares if your employer don't care.


3. check your company's recruitment

The RLMT takes some time, but I believe if a company is big enough and it has been already advertising the same position as yours on their website for a certain time, you may not be required for the RLMT.


4. check a salary you need in accordance with a job title you want to apply

You should check it beforehand, so you can tell it to your employer when you discuss with them. If you want to suggest some job titles, you had better check them beforehand as well.


Those are just preparations to seize your situation and what kinds of possibilities you have in hand.

Once you are ready to talk to them, don't be afraid. They will like you. So talk politely and nicely, but logically. You will have already prepared well to convince them how valuable you are for the company.
