no ni no, no stay permission and joint claim for CTC + WTC

hi all, my problem is

my husband came to the UK 7.10.2002 with a visit visa and did not go back
we had a daughter together on 9.5.2010 i got told to claim singly
we then got married 5.7.2011 so made a joint claim to CTC and WTC on 5.7.2011
my husband went to NI no interview on 3.11.2011
yesterday we have received letter back stating that he has been refused a NI no (which i knew would happen)

and my question is

Can you give me any advise as to what will happen next? and where i go from here

Ask your husband to regularize his status first if he is out of status before applying for NI .Get help from a solicitor.

If he has status and they refused him NI you could appeal against the decision not to give him NI.

The claim has already taken 5 months and we are living off 40 pounds a week after payingbills, we can not afford to apply to ho for anything at the moment so can not sortvhis status in the uk till we have our wtc and ctc in payment again

please any advise please now being told its been escalated and are going to be sent for another interview to be declined again. how long is this going to go on for
