if appeal for student ''Reject'' by judge after hearing

Post by atifaslamansari » Fri Nov 25, 2011 1:59 am

Hi there, first of all thanks for your assistance previously.
Today i had attended my hearing for student visa, my visa was rejected on the grounds
1.. i haven't provided original mark sheet for Esol from city and guilds with my application.
for which i contact city and guild by email and they replied with answer that'' we don't give mark sheet for esol its just either pass or fail''
I presented the copy of that email into the court and explain to judge that its not my fault if they don't issue mark sheet. and judge was not seemed quite satisfied from my answer and he said he is going to keep my case and will make decision in 10 days after future investigation whether mark sheet exist or not.
I tried to show him IELTS which i have done after rejection of my visa and got 6.5 each but he denied to consider any additional certificate which have not been provided previously

my question is to '' if he reject to grant me leave in UK''

can i appeal against his decision in any other superior court ?
or what would be the consequences in case i get rejection from Tribunal
do i need to go back to my home country ?

i am very worried about it please can any one assist me for any other way in case of rejection

much obliged

Yes you may be able to appeal against the judge's decision, for that u need to wait till u get notice of decision from the judge, that will explain what you can do next.
In most cases u can apply for permission to appeal to upper tribunal and then apply directly to upper tribunal for permission to appeal, but there is very very less chance that it will succeed as it is only considered if there is an error of law.

For City & Guilds you need to provide:

Certificate and Notification of Candidate results sheet (Speaking result on a separate certificate and Notification of Result sheet).

One must assume that anything less or other than this is not acceptable. Can you confirm that you have these documents?
