I am on two year post study work permit that is due to expire in the next 3 months or so. I have lived legally in the uk for the last 7 years and previously lived 4.5 years in Europe.
I also now have a one year old boy whose father has ILR but has refused to apply for his british passport as we are now separated.
My question is

1. Is there any way that i can apply for my sons british passport.
2. Can i apply fo an extension to live in the uk given that my son has a right to british citizenship.
It would be very difficult for me to return to uganda having studied. worked and lived here and now have a son.

Please advice.

The child's father will need to apply for British Passport for the Child, as he is the settled person.

Without details of his settled status and a paternity report or his name on the Child's birth certificate, child will not succeed in such application.

If there is child support arrangement or other details, you can use it to claim that the child is indeed a British Citizen.

You may be able to claim residence on the basis of the child once the issue of his citizenship is resolved.

You are not settled, therefore the child cannot claim any right to British Citizenship from you.

You have not resided in UK for 10 lawful years yet, therefore you cannot claim a right to ILR.

Thanks obie for your response, really helpful.

His father is named on the birth certificate. We had a private agreement for his sons maintenance which he continuosly defaulted on so had to get the csa involved. Case is still ongoing.

Can i use this to apply for my son and how do i go about it?
