ILR - 10 Years vs 5 Years WP/T1

ILR - 10 Years vs 5 Years WP/T1

Hello Guys,

I need some advise on my ILR Routes please.

I qualify for ILR under 2 routes:

10 Years - February 2012
WP/T1 route - May 2012

I have a wife & 2 children(born in UK) as dependents.

Originally I was inclined to use the T1 route in May. However, with rumours about proposed changes to ILR, I was thinking to go under 10 years rule & get it over & done with. Although they mention that the changes will not affect pre April 2011 candidates but who can stop them from doing something otherwise, u never know.

1) Now under 10 year route, I beleive every1 else will be okay apart from my wife who will 1st need to get an FLR M extension for 2 years and then apply for ILR (if the rules dont change), is that right?

2) Could you guys suggest any other possibility for my wife to get ILR quicker?

3) Could I apply under 10 years and the family via T1 route?

4) Is there anything else you guys could suggest to help me make the decision apart from the possibility mentioned in 1?

I would love to have the whole family pull through in one go and would really appreciate any advise on my situation.

1. Under 10 years u can not get ILR for your family but extension and then ILR.
2. Also remember if you go for 10 years then your wife needs to pass an english language test to qualify for extension.
3. I am sure with workpermit and tier1 u cna include your dependent in your application.
4. If you chose 10 years then family can not apply under Tier 1 as u status is changed and they will have to use FLR(M) for extension.

If you were a single applicant, then I would suggest applying under 10 years rule. But you have your family with you and if you are confident and think there are no issues with your ILR based on Tier-1, then apply under Tier-1 for ILR.

This way your family will get ILR a lot quicker.

I'm also in the plan of applying for ten years ILR In Jun 2012,

Can you please let me know are there any proposed changes for Ten Years ILR.

My wife got has done her Education in India and also it was done in English. Still she has to write her english Language test? or she can apply and check her qualifications to UK Naaric.

Please suggest me.

I'm also applying in the process of Ten Years ILR and I would be qualifying for Ten Years ILR in the month of June 2012. In your earlier post you were saying that rules gonna change. Please let me know any changes are being planned for Ten years route.
