Do I have to wait 3 months before WP expires to apply Tier2?

Hi

I hope someone can help me ons this. I am currently still on the old WP scheme, my permit expires Aug 2012, can I apply now or do I have to wait untill May 2012 to apply for Tier 2?

I believe you may apply within 3 months of your current visa expiry
