Hi All,

I have got a question to ask regarding my wife visa status. My wife came to UK on Tier 1 dependent visa. Last year we both had applied for extension and got 2 years Tier 1 extension visa in July. My 5 years residence criteria for ILR eligibilty ended in Nov last year. I knew that my wife couldnt apply with me for ILR so I had applied alone and got ILR . According to UKBA she has to change her visa (FLR M) as a dependent of settled person. Now we have to urgently travel to our home country. Can she travel on Tier 1 dependent visa bear in mind this visa is valid till July 2013.

She may be refused entry (321A). Safer if she changes status first.
