Please help - 2nd Tier 1 General Extension (early extension)

Please help - 2nd Tier 1 General Extension (early extension)

Hi everyone!

I am currently on my Tier 1 after extension from HSMP
I will be 7 months short to apply for IRL, therefore planning to apply for the 2nd extension. (and I'd rather need to do it within a few months)

<<timeline of my visa status>>
Initial HSMP issued: Dec 2007 (2yr)
Tier 1 Extension: Jan 2010 (3yr)

After obtaining my initial HSMP, I didn't move back to UK until 30 July 2007, which means I am 7 months short to be qualified for ILR.

So I believe I need to extend my Tier 1 once again.

My current visa is valid until Jan 2013, but I don't mind if new visa starts from April/May 2012 instead as I'd be in UK long enough before next visa will expire.
And from what I have read on this board, Home Office would process our early extension application much before the expiration as long as we earn minimum 75 points.

Sorry for the long introduction, but my questions are :

1) Do I need to score 75 points using the same points table I used for my current visa application? (education, previous earning, age etc)
It's very confusing......

2) When will I be able to apply for ILR at the earliest? Would it be 28 days before 30 July 2013 or could I apply earlier than that (May or June)?


I would like to be able to send my ILR application in June the latest as I'm at the career shift and would like to include my income for March 2012 for IRL application. Will I able to include my salary on Mar 2012 within my IRL application if I am to send the application at the end of June???

Could anyone please advise me?

You should use the PBS calculator that is available for Tier 1 extensions. I don't see any confusion in that because there is no other calculator. You do need to score the required points.

You will be able to apply for ILR once you complete 5 yrs continuous stay in UK. You cannot apply earlier because you won't the concession of 3 months as you came 7 months late to UK. Once you complete 5 yrs, check that you should not have 180 days leaves away from UK and no continuous 90 day leave period away from UK in that 5 yr period.

I've checked that calculator you've mentioned, but according to that, I won't be able to claim points for my Bachelor..... :cry:

Does it mean I cannot claim for m degree though I've earned 30 points for it with my 1st extension?

I know if your "initial/first" Tier 1 application was made in between 31 Mar 2009 and 5 Apr 2010, you needed to have at leas Masters, but I could extend from my HSMP to TIer 1 during this period without having Masters. So in such circumstance, will I be able to extend my visa using the same point table (the one I used for my extension) ?
