Spouse Visa Documents - (India to UK)

Post by pazpatel » Wed Feb 22, 2012 12:20 pm

Hi everyone :D , and thanks for reading my post, really hope you can help me and hope I can also help some of you out to.

We are just waiting for my wife's passport to come back now, (that is a headache in it self) and then we will be applying for a Spouse VISA from India to come to the UK.

Anyway - I met my gorgeous wife back in March 2011 and we also got engaged, then in October 2011 I visited her again for 10 days, and finally in December (31/12/2011, New Years Eve) we got married. I am born and live in the UK so naturally hold a UK Passport. Wife is born in India.

These are the documents I have ready and about to submit, what do you think? will I be okay?

Financial & Work; (I am a director of my own company which is in a partnership of 3 people)
• 12 months bank statements & savings statements (Personal) - Savings show an average of about £5k per month. And Bank Account shows average of about £3k income.
• 12 Months Payslips (only problem is my payslips only show £550p/month in some and £1000p/m in some) - Minimum amount as director of my own company, rest of my income is either a drawing or dividend)
• Letter from bank confirming how long I have been a customer, average balance over last 6 months, and that I am Advance and good customer.
• ICICI statements showing some money in India as well as a 5 year fixed scheme.
• Joint ICICI account which we opened in January showing an 83,000 balance in Rupees and again another 5 year fixed scheme which is both our names.
• Work Contract (This is a contract between us 3 partners)
• A letter from my account and two business partners stating I am a still a director in the company, my salary details and the fact I have a director loan account (which is where the remainder money comes from), and also how much tax I have paid, as even though not on my payslip I have paid a sum of £3500 to PAYE for a Bonus I paid my self of £10,000 to reduce the directors loan account. It also confirms I have access to the debit card and Credit Card.
• Couple recent statements for the business bank account & credit card
• Payment receipt for PAYE lump sum of £3500.
• End of year accounts (for 2010, - 2011 has not been done yet)
• Management Accounts from since the business has been running.
• P60 for the last 3 years.
• Last two years of self assessments
• Share certificate & HMRC document showing me becoming a director. Also VAT Certificate & Company Registration certificate. Corporation tax documents for last year.

Accommodation
• Over 40 photos of our home (inside & outside)
• 2011 Mortgage Statement (Which is in my parent’s name)
• Council tax Bill for 2011 including an up to date statement of payments
• Water bill in my father name
• Gas & Electricity bill in my name
• Deeds for the house along with plans (blue prints) for the house from the council for some work we done couple years back.
• Letter from mum and dad confirming the house, and that I live there and giving me and my wife consent to continue living there.

Other Bits & Proof of marriage
• Wedding invitations (both sides)
• Telephone records (online print outs from Reliance, Rebtel, Pennytalk and Airtell)
• Skype log (again copied & paste version as it does not allow you to print
• Raspberry Messenger Print outs, Emails
• Emails of bits I have bought for her like flowers, on line gifts etc.
• Western Union money receipts / emails
• Parcel receipts
• Photos from our engagement, trip in October, wedding, Honeymoon and random pics from while I was in India after the wedding
• Photocopies of my passport (all pages) signed and stamped by a solicitor.
• Birth Certificate (Original left in India, also a notary Copy
• Airline stamps, tickets and receipts for the tickets
• Letter from my business partner
• My own sponsorship letter from before the wedding, and also one from after wedding when I got back from India. Couple letters explaining some of the documents.
• Driving licence, plus log books for two different cars in my name

I think that is everything. Am I missing anything or do you suggest anything else that might help?

Also do you suggest using an agent in India or doing it my self on the VISA4UK site?

The only thing I have signed by a solicitor is my passport copies and notary of my passport page and birth certificate. Do you suggest anything else from the list or away from the list?

Final question – What should be included on the sponsor letter from me (the sponsor)?

Any help on this would greatly appreciate.

Thanks for all your help in advance.

Hi

Its such an exhaustive list of documents (good).

I would also add the following:

- House/rooms measurement or a house inspection report - showing that your house will not be overcrowded when your partner joins you in the UK

Also if you can fill up the application form without any problems, you do not need anyone to represent you (like an agent in India etc.). Just go to the VFS office nearest or convenient for your partner to go to and submit your application.

Hope this helps

Hi Harv,

Thanks for the info, I have included plans of our house, which have been stamped by the local Council (Richmond Upon Thames) these plans are from when we built a loft extension and rear extension about 3 years ago, these include measurments would it not be enough. Dont really want to pay for incpection report.

Also from the tax banding they can see what size house we have. And tehre are about 40 pictures of my house too.

Finally - Do you know if UKBA do criminal checks on me or my wife?

Also noticed on one of your posts Harv, you also have your own company and pay your self the minimum, do you think there will be any problems? I am worried they check my tax code and NI number. My bank statements clearly show money coming in from my company with the reference drawing. Also my account has written a letter which my 2 partners have signed too. Will I be okay? What have you done?

Also noticed you filled your application on the 8th Feb so everything crossed for you and hope you get a answer real soon. I hear some people are getting answers at the moment in about 4-6 weeks.

Hi pazpatel

Yes, I think that should be sufficient as an evidence. The only thing I am worried about is the date on it, you mention its 3 years old. I am not sure whether you would need a new one or not. A report should outline the capacity of the house and show that adding your partner would not overcrowd the house.

I believe UKBA do perform criminal checks, however I am not sure if they do it with every single application as this can take a long time and may cost a huge amount.

I am a company director and pay myself a minimum salary + dividend on monthly basis. To show this I got a letter from my accountant confirming that I am the only director of the company and my salary. I also included my last year's company accounts. I think this should be enough from my side, hopefully. Although I have not provided any evidence on my NI number eg copy of my NI card etc.

Hopefully I hear soon (positive of course) from UKBA...

Hi Harv,

Thanks for your reply again.

I might just get a new report done to be on the safe side I think. I have just spoken to a estate agent friend of mine, he can sort out a surveyor to come round and write up a report.

I dont know if you have to actually provide a copy of your NI card, but they ask for your NI number anyway on the form, also it will be on your payslip.

Fingers crossed for you and do keep me / us posted on your status too.

So where do you live are you in the London areas? When did you get married?

Oh also - What documents did you submit?

Very Similar to mine Harv so shoudl be okay, are you still in India at the moment then? Also did you not have to get her passport name changed or anything, people in India (Agents, VFS) advsied me that I should get my wife's dads name taken out of passport and have mine added. We got married on the 31st Dec (New Years Eve), got marriage certificate on the 3rd, but only just got the passport back though with name change.

She already had a passport but it has her fathers name as middle name, we both have the same surname though.

I am in Twickenham so not to far from Uxbridge. Where is wife? Delhi area?

It is real tough though, been back in the Uk since 1st Feb (so I spent just over a month out there) but miss her so much.

Fingers crossed for you bro.

Also what did you include on the sponsor letter? I have wrote about 5 pages, just about how our relationship strted, grew etc, special dates and things that have happened in our 10 months before marriage etc etc. I have also wrote a second letter for after the wedding too which talks about hwo happy I was to see her before the wedding, the wedding day, our honeymoon etc etc etc again another 4 odd pages. Got a letter from my parents and business partner too.

Hi pazpatel

I was not told to change her surname and as far as I know it is not a requirement to do so. I think majority of the people change their names when they are applying for the British nationality. This saves cost and hassle on the same time.

Oh Twickenham, so not that far indeed.

I went for 3 weeks and came back last weekend, so did not spent a lot of time there, missing her a lot.

My Letter was just a page long and I briefly outlined the whole situation i.e.

My employment details and finances
My relationship
My future plan i.e living together etc.
