Please do you think this is true?

I have invested money worth £400,000 on buy to let properties in 2008 and 2009 and I still have the investment up till now. This money includes buy to let mortgage and my deposits.
I planned to switch into Tier 1 Entrepreneur based on changes Home office made on 13th Feb 2012 and use my existing investment. Immigration lawyer told me I can’t use my existing investment and that it has to be money invested within the last 12 month. He advised I have to sell the properties re-invest the money.

Please advise if this is true.

Thanks
