HELP WITH MY BABY

Post by xtrm83 » Thu Feb 23, 2012 9:55 pm

Hello every1, Im here to get advice in regards of the following situation:

Im a EU italian citizen in the UK. In may 2011 I married a colombian national and we did apply succesfully for an EEA2 permission for her to stay. During the month of July we had our baby, hes currently receiving Child Benefit and Child Tax Credits, hes got an UK birth certificate etc, etc.

In november, we left the UK in order to take holildays so the family could also meet our baby. Before of leaving, we did his colombian passport, since the italian one it was so difficult to get it during that time, specially because of the waiting time.

We spent a lovely time abroad until i got on my nerves when people started to say that the baby could not enter the uk unless hes in possesion of a family permit. In Colombia the service to do the famlily permit is not free as the UK border says, they make you call to a Call Center and they charge you 3 dollars per every minute you spend.

Anyway! the reason im writing here is because we dont have much time left, we are returning to the uk on the 7th of march and I know that wont be enough time to do anything. What would it happen if I enter to the uk with the baby on that situation, when im a EU national and my wife holds an EE2 Residence Card.... Are they going to deny access to the country?? Are they going to ask him to return on his own when hes going to be on that day only 8 months old???

If it makes sense to any of you, i would love to hear the reasons why, but i will also like some advice from you.

Regards,

Gian

If the child arrives in the UK it will not be refused entry if you have evidence of its parenthood. The airline, however, may not be inclined to board a child in Columbia that does not have an entry clearance for the UK. You should check.

However, a carrier may deny boarding to a family member who is not an EEA national if he fails to produce the required documents. Therefore, carriers should be advised that such a person is inadequately documented if they seek advice before the person travels
