Tier 2 ICT Long stay eligibility

There is a guideline for UK Tier 2 ICT Long stay Visa that a person
can not return to UK as an ICT within 12 months of expiry of last
period of leave as an ICT. (Page 9 in
http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary
).

However I had a Tier 1 Work permit (Not HSMP) issued in 2008 for 2
years and the Work permit got extended in 2010 for an year (with
the issuance of Resident permit) which expired in Sep 2010.

Since I never had an ICT, I think I am eligible for the 'UK Tier 2
ICT Long stay Visa' and the guideline above isn't applicable in my
case.

Can anyone please confirm?

Switching into Tier 2 (ICT Long Tern Staff)

In order to meet the requirements you will either be
1. ICT Established Staff
2. ICT under the rules in place before 6 April 2010
3. ICT Work permit holder
4. Representative of Overseas Business

In all cases you must still be working for the same employer named on your previous applications.
