Discretionary leave to spouse visa

Post by momo1 » Sat Feb 25, 2012 4:12 pm

Hi guys, I leave and work in the UK and was given a 3 years discretionary leave because I was fearing to return to my home country. My condition have changed since I am now married to a British citizen and we have 2 kids, I do not fear returning to my home country any more. I am planning this summer to go back and apply for a spouse visa but when trying to send my application on line I was ask my country of resident which is the UK but it wasn't possible to select the UK. Do I need to notify the home office that my condition have changed and I am going back home to make a new application? Can somebody please help? Many thanks

Select your country of nationality rather than the UK. It will be evident from the answers to the questions that you have been resident in the UK but you can reiterate this in the additional information field.

Discretionary leave is not given on the grounds that you fear return to your country it is given on the ground of family or private life in the UK or if for example you came here as an unaccompanied child. When does your discretionary leave expire?

It's expired on the 23 January 2013.

Post by momo1 » Sun Feb 26, 2012 6:36 pm

Hey guys,
Does any body know how long it takes to process a spouse visa in Ghana, specially for someone leaving in the UK already on discretionary leave?

Hi Guys,

can i apply for extension of DLR (non asylum) at PEO. Since the form FLR (O) only says only 10 year rule cannot apply at PEO. It did not mention if DLR non asylum can use it. Does anyone have any idea or experience about this.
