Post by aps » Sat Feb 25, 2012 10:09 pm

Hi Friends,

Need your precious advise on my case for ILR , currently on T1 General . Will apply for ILR in May 2012.

First Entry date at UK : 3rd June 2007 so please help in below points:

1.) Can I apply for ILR on above date - 28 days ?

2.) If I apply on 15th May in that case regarding, Salary for last 12 months out of 15 months should be OK as :

a.) April 2011 to March 2012 ? or
b.) March 2011 to Feb 2011 ?

Are both the above date valid ??

3.) Cohabitation documents need to be for last 2 Years from date of applying ??

4.) One of the cohabitation doc could be council tax but my council says they have replaced new machine hence last year bill could not be re-send as an alternative for last year they have given me a letter from council which says Mr abc and Mrs xyz have been at the address since <> and paying there council tax record is up to date. We cannot provide last year bill hence , consider this letter as an proof.

Will this letter be equivalent and accepted by case worker ???

5.) Similar case exist for EDF bill , they have given letter on letter head mentioning that Mr abc and Mrs xyz have been with edf and on address <> since 28th May 2010.

6.) Rent agreement and bank statements should be OK for cohabitation docs OR above docs as in point 4 and 5 also required ???

Kindly help friends ..........

Thanks,
APS

Hi aps,

To answer your queries:

1. Yes you can apply 28 dates before your 5th anniversary date of entry. i.e., if you entered on 3Jun2007, you can apply 28 days before 3Jun2012

2. UKBA states any continuos 12 calendar months in the 15 months prior to the application. So yes, you may show both a) and b)

3. Cohabitation - the recent two years before your application. Please read http://www.immigrationboards.com/viewto ... ht=#537229

4. I personally believe UKBA will accept the letter from the council (seniors may have to confirm). However, if you can, it is better to also provide a Bank statement, tenancy agreement etc to support it

5. see above

6. see above

Good luck with your application.

Many thanks for the time dear friend.

Regarding Cohabitation doc - If I provide rent agreement from :

29th may 2010 to 28th may 2011 and then
29th May 2011 to 28th May 2012

but I plan to apply on 15th May - will these be considered OR shall I apply after 28th May 2012

Same for council tax .

These are basic things but when days are bad - these can also become hurdle

Hence, I plan to take advise from group before taking any step.

Thanks,
APS

If you are applying on 15May2012, you need to be able to show documents that you were cohabiting at least from 15May2010 or earlier.

If you are unable to show cohabitation before that, I would suggest you apply on the 28th.

thanks again !

I thought the same and to be on safer side and apply after 28th May - why to take risk by applying 15 days earlier

Thanks for time and help
