criminal convictions

hi all, i have a question. according to new immigration law, if someone have a criminal conviction, he will have to wait until it became spent in order to apply for ILR. i wanna ask, whether this law applies to all applicants or just those who convicted after this law has been implemented plz? means, if a person comes to UK in 2008 when there was no such condition for ILR application for such person, will the same rule apply to him as well if he has a conviction and court imposed fine but before the implementation of this law? could anyone advise plzzzz
