Extending Tier 1 while beeing out of UK mostly

Post by Jusa » Sun Feb 26, 2012 7:24 pm

Please give me an advice. Maybe someone had similar situation and knows the way out, Please help

Here is my situation. I got my Tier 1 in June 2009, spent 2 weeks in UK and went to home country where I got married shortly and then had a baby, so I couldn't reside to UK right away. I'm still in my home country because of the family issues. My visa expires in June 2012
Is it possible to extend my Tier 1 under that circumstances. Will it help if I apply in UK? Is there any way that i can do it? The initial application was made from my home country. Please suggest

Thank you

You can only extend from the UK. Bear in mind that you will not be apply any uplift ratios to your earnings outside the UK.

I don't think the above post helps in Jusa's situation.

It does if you read the dates in the post below. He/She was in Australia all along and only came to UK to get T1 extended. PM cheerypie to confirm this :

Hi there,

I applied for my initial tier 1 visa in 2008. I entered UK in Jan 2009 and only stayed for 5 days. I re-entered in Dec 2011 and applied for a tier 1 extension and I have recieved this in Jan 2012. I left last week to come to Aus to apply for my husbands dependent visa and once this is processed we will return. I am not aware of this 3 month rule. I believe you won't be eligile for Indefintite leave to remain in 5 years because you would have spent too much of time outside the UK but I think you could just apply for tier 1 extension
