Post by kichu7 » Mon Feb 27, 2012 12:42 am

Hi Friends,
Plss if someone could help me regarding my earnings. I have my extension due in dec 12 and will be filing an application in nov. I got a job in feb 12, can I claim points on earnings of 9 months? or 12 months is necessary?
I am earning 42k+2500pension+15%bonus P.a.
what earning do I need to show? Can I claim on bonus and pension as well?
I am a lot confused regarding this!

kichu7,
9 months are allright its ur visa, ur options just must these 9 months placed in 15months before applaying ur application, then i think u can't claim all the 42K coz u r talking about 9 months by then. i do belive that the pension is deducted from ur 42K (gross income) and ur application u calculate as a gross income (before tax, privet pension, helth insurance, shares etc ....) about the 15%bonus well u can claim what ever money u recive once u have 2 diffrent evidence as u know that

I got my first pay slip and the gross pay mentioned is 4100. After tax its around 2900. So can't it be like 4200 for 9 months i.e. around 36400.
I have the following points
Age - 20 points
qualification - 35 points
earnings - 20 points
uk experience - 5 points
total is coming to 80 points

Is this fine?
Pls help!

Yes, it is fine..As long as u earn enough points it is fine to show 9 months salary.

You can show pension as your income but you can show Bonus as ur income if it is included in your pay slip and credited into your bank account in the same as your salary.

My salary slip includes
Basic pay - 3823.08
Sports allowance- 50.00
Pension allowance- 229.38

Taxable pay is 4102.46 i.e. total of above.

So can I claim points on this amount i.e. 4102.46 for 9 months?

Normally the company doesnt include the pension allowance in the pay slip. I will leave it to the guru's or moderators to help you with the query.

The highlighted is not what you have "Earned". I presume that is the contribution your company makes on top of yours (i.e if you agree to save 3% of your salary on a yearly basis, company usually contribute x1.5 or x2 or x3 etc of your contribution.)

I do not want to get too personal but if you share (or PM) your exact numbers including Tax and NI deductions, it might be of help to determine if you're paying the tax on your pension allowance.

Thanks mate. But this is still not helping to conclude anything. Can you please put a yearly breakdown of your Basic salary and other allowances? Or perhaps, you would like to visit thesalarycalculator.co.uk or something similar. Things you need to establish -

1. Are you paying tax on all of the items listed on your salary slip. Because punch line here is, you are able to claim points for your earnings where you pay tax.
2. If you are paying tax then you are welcome to use that earnings to claim points

If your pension allowance is part of your salary package (means employer has to pay) and included in total payment (as declared on salary slip) and taxed then you should get a letter from employer stating that it is contractual payment (i.e. they have to pay irrespective of what you do with this money) and part of your earning and NOT pension contribution by employer. Make it clear in letter and attach with your application.

In case anyone is still struggling with it.

I had a PEO appointment yesterday I explained the situation about my pension and gross in come in cover letter.

in the end I gave the my total earning as

Total Earnings : Sum of 12 month's gross pay (excluding pension) + amount contributed towards pension in last 12 months.

The case worker didn't asked me single question about it so i am assuming she understood what i was trying to explain.
