citizenship 5/6 year rule clarification ( 28 days)

Post by nf3nf6 » Mon Feb 27, 2012 3:16 pm

Some website claims naturalization can only be claimed after 6 years of residence. This includes 5 years to get ILR and 1 year to hold ILR.

But because you're allowed to get ILR upto 28 days before 5 years completes ( assuming you went in-person for ILR and received it same day), does it mean you can also get citizenship upto 28 days before 6 years?

This is because you held ILR for 1 year and you were resident for 5 years 11 months, so you also satisified 5 year residency rule.

I understand that 28 days are hardly worth the hassle, but just want to know if this is possible theoretically because I don't want to wait?

thanks in advance for reading and answer this post.

regards

The residence period is 5 years (not six as you have suggested) but holding ILR for 12 months is an additional requirement. Using your model, the person has to wait until they have held ILR for 12 months. They can't apply 28 days before the 1st anniversary of their ILR grant.

thanks for the reply. However because ILR had already been obtained 28 days before 5 years, so am I now allowed to apply 28 days before 6 years?

I fully understand 1 year requirement for ILR.
Please clarify.

Yes, because the residence requirement is for only five years (not six) and as long as you have ILR for 12 months.
