Hi

Just wanted 2 ask if any one can give their valuble suggestion

here is the visa and Travel history

Visa issue Date : 08 FEB 2008
Visa Expiry Date : 08 FEB 2010

Entered UK : 04 JUne 2008 (entered UK after 117 days from visa issue date)

New visa : 17 Feb 2010
New Visa Expiry : 17 Feb 2013


My Question is will i be able to apply for ILR 28 days before my current visa expires or do i need to go for another extension and apply for ILR after covering that 117 days.

Please suggest.

I am guessing you hold a spouse visa. If yes then you can apply 28 days before you complete the 2 years stay in the UK, you won't have to wait till your current visa expires. So in your case you should be able to apply for ILR in May/June 2012.

not sure why you are guessing that because the OP originally had a two year visa, and then was issued an extension for a further 3 years, perhaps the OP should be more specific about the category s/he is applying under.

Sorry if there is any confusion

I am in HSMP (2 Years) first and then Tier 1(3 Years).

HSMP Visa valid From : 08 Feb 2008
Entered UK : 04 June 2008 which is 117 days after visa issue date.
HSMP Expiry Date : 08 Feb 2010

Then Applied for Tier 1 Visa

Tier 1 Valid From 17 feb 2010
Tier 1 Expiry : 17 Feb 2013

You are allowed to delay your first entry into UK
By three months.
