My case is rather bit complicated. I guess i am eligible to apply for ILR (based on duration and points) but having trouble with my financials.
I came to UK on Aug 2006, on a work permit and then moved on to HSMP in 2007 and then to Tier 1 on 2009.
I was made redundant and was unemployed from Oct 2011 - Jan 2012 (4 months). But untill then i was in a decent job and my salary breakdown was:

As you can see from above i was unemployed for 4 months, in the last 15 month window, though i can show the earnings for the rest of 9 months and would still qualify
Salary £40K+ -> 45 points
Age -> 5 points
Education - 30 points
UK experience -> 5 points
Total = 85 points while i need only 75 points, never overstayed or stayed outside UK more than the allowed quota.
My concerns:
1. Can i show just 9 - 10 months (consecutive) of my earnings instead of 12 months within the last 15 month window?
2. Due to unemployment my bank account took a hit and was contstantly in overdraft between Oct 2010 - Feb 2012 (though i am not claiming earning points for these months anyway), but will this have a bad effect on the outcome of my application?
3. Do i even need to show my bank statements for the last 4 months as i am not claiming any points based on that?
4. Do you recommend to apply now or do you suggest to wait for another 3 months to manage the moneyflow in the bank account to apply?
I am currently working in a contract position though i was told that the work will go on till end of may, we never know of what could happen. thats why i am in a dilemma of whether should i apply now or later.
