Daughter will turn 18 in December..

Post by cynsleigh69 » Wed Feb 29, 2012 6:58 pm

Hi
My husband is a Brit Cit and I am american. We are going to move to the UK at some point but we are worried that we might have to do it by the end of this year before my daughter his step daughter turns 18. She has to go with us and it can not be a situation where I have to go over there first and then she can join us in a year or two after I have arrived. She is disabled and has to have my care. Is it possible to get her over there with us? The British citizen is her stepfather he did not adopt her. Her real father is not in the picture and not on the birht cert or passport so that will not be an issue. If any of you know please let me know. I'm freaking out because we really don't have the funds to move there this year.

It's possible if you have sole responsibility for the child, and from what you have stated it appears that you do, but you should make sure of this with regard to local family law before you apply; you will need to provide proof of this. You have to apply before the 18th birthday. The child will be granted leave to enter in line with you and you may both then apply for permanent settlement after the mandatory probationary period. However, maintenance and accommodation conditions apply to the visa application.

Although different circumstances, this thread (linked below) outlines what you may expect with regard to finances (your family is the same size so the sums apply equally to you). Third party support from family other other reliable sources are permitted.

She should apply prior to turning 18. Here's more on sole responsibility.
