ILR for Dependent

Post by vnraja » Wed Feb 29, 2012 7:45 pm

Hello,

Apologies if my question has already been answered. I am a ILR holder residing in UK and I was granted ILR in Feb 08.

My wife got her spouse visa in Feb 2010 (when we got married), which expires in April 2012. And she did join me in UK in Feb 2010.

In October 2010 I was offered a 6 month contract in India and we both left UK and I came back in April 2011, and my wife joined me in July of 2011.

In total my wife has been away from UK for 10 months ( along with me), Can she now apply for the ILR, or she need to get a one year extension and only then will be granted an ILR.

I have gone through all the documents in the homeoffice website, but was unable to find any mention of this being a problem for ILR (It does state that it is a problem for citizenship).
Could any one please let me know if this would be a problem and she should apply for extension or ILR.

Hope I have been clear with my question.

Thanks
Raja

She should be okay.
