Discretionary Leave to Remain Under Article 8 ECHR

PLEASE READ IT AND HELP ME.

First of all i would like to tell something about me that I came in UK in 2007 as student visa. After getting my Master degree and i am in PSW visa right now which will be expire in may 2013.

After long time last year ,I went to Pakistan for seeing my wife and baby . I did love marriage with my wife .From the very first day my in laws creating problems for me like misbehaving , abusing but i controlled my self because they belong to my wife family. I always given respect every time but in reply i faced every time bad attitude.

Now i want come to point when i went Pakistan . during my visit in Pakistan when ever I went their house because my wife and my baby living in their house I tried to convince to my in laws to accept me as their sister’s husband .Onw day I went to their house as usual to seen my wife and baby ,my brothers in law attack me and physically hurt me badly and threw me from stairs.

My wife and took me to the hospital in emergency because at that time i was unable to move right or left after fallen from the stairs . Dr sent me for MRI scanning and in the report diagnose that i have suffer back injury in spinal disc. Dr advised me for the sugary immediately. After having spinal surgery i come back to UK because i was scared to my brothers in law after that incident .

my wife and my baby still are in Pakistan . i dont want go to back Pakistan 3 or 4 years more until i will feel secure my life from my brother in laws. My visa is expiring next year in June.

My question is shall i apply Discretionary leaves on these domestic and medical grounds which i happened because of physical attack of my in laws that cause of surgery . i have still spinning i am taking medicine regularly. I have all medical reports including MRI and surgery , hospital records while I was admitted there .

I need time to sort out my personal matter and i dont want to go back until i think my life will be secure there

To the best of my knowledge the HO will NOT consider personal circumstances to grant leave. Hence an application may be futile, but maybe the more senior people on this forum can advise better

If you want to seek advice from a solicitor then your should do so yourself rather than asking a complete stranger to do it for you. Your case is too complex to seek advice on a public forum. You need advice from a professional. Article 8 is about right to a private and family life not about fearing harm.
