Married to British and have three months old child HELP!!!!!

Post by Rebeka Long » Thu Mar 01, 2012 2:57 pm

Hi
My name Rebeka Long and i am new to this forum.Looking for help on serious and complexed immigration issue.Any help would be much appreciated and my best prayers will be with you.
I am a UK born and brought up here.Married and has a baby girl.Question is about my husband. We have spent a lot on going to solicitors.W e are confused.
Case Background
My husband came here in the UK October,2004 as a student. He studied here until 2008 and then applied for PSW which was rejected But he didnt know thw outcome of the application as home office lost his documents and in a nut shell his solicitor asked for data file through which he came to know about this application been turned down.We were married that time he decided to appeal but in tribunal appeal the again confirmed with college and believed in college not him even he had all the proofs of being a genuine and bonafide student. It was shocking for me because when my husband used to study there it was a rated good college but after finishing his course if college start being a diploma machine and home office suspened thier licence many times. The court didnt believe him then his barrister talked about me pregnant and married legally here. The court interviewed me i was a bit confused and did few mistakes as i was in the court for about six hours waiting being heavily pregnant and sick. When you are pregnant it happens you lose your mind some times.Appeal rejected with no right of appeal.
Then his solicitor sent Human Rights application using FLR(M) form and it also been turn down with no appeal. And now we are with a new Solicitor apparently very good he didnt let us do the Judicial review rather he said make a new application using FLR(O)

We are so confused.Dont know which from we should use and how he will get his status regularise as he would go back but i cant look after the new born baby myself as i dont have any one even no family no one except him.

Been told do the application on Human Rights article 8

But dont know which form and how it will work out because if we do FLR(O) He will have DL of three years and then three years extension and then after six years ILR and if he does FLR (M) he might get two years.

But some one said do FlR (O) get it go back home and apply from there spouse visa and come back

My husband he has been working here has a clean record Crb checked

Is there any one who could help us out Please any help
Thanx
