Legacy Cases: Article 8 and Lead Cases...

Post by taraskyn » Sun Mar 04, 2012 9:04 pm

Hi,

I just discovered the Article 8 and I am very impressed.
The Article 8 itself is based on a number of lead cases.

Quote from Article 8: Casewokers should consider implied Article 8 claims alongside the asylum claim in all cases. Any Article 8 issues should therefore be examined at interview and, if the claim is to be refused, addressed in the RFRL, regardless of whether or not the claimant mentions Article 8 specifically.

Questions:

Q1: If it is a case how likely Article 8 will have an successful impact on a case?
If YES then can Article 8 be pointed at in further submission form? Or is the fresh application needed ( if original application refused)?

Q2: Do the Lead Cases make a case any stronger?

I will be adding more general question into this topic mainly about Article 8 and related to it subjects.

Thanks to All... :D [/b]
