Help Urgent

I had sent my visa extension on 16 of december 2011 and due to payment issue UKBA returned all my documents back and asked to submit a fresh application which I did on 9 of jan 2012. Now i have recieved a refusal for my T4 extension on the grounds of not having sufficient funds, but I recently finished my ACCA in NOV 2011 and I'm a established student so I provided the bank statement of 1200£, ended 22 Nov 2011 and visa expiry 18 December 2011.

According to UKBA they have considered my application on the 9th of jan 2012 not the 16 december and they are stating i'm not a established student and need to provide 5400£ and they have not given me any appeal rights either.

Could anyone help me in this matter what should I do as they have given me 28days either to leave the country or submit a fresh application.

The best thing is leave the UK quickly and apply from outside with required funds.

that's not the best thing at all - if his visa expired on 18 Dec then s/he has overstayed for more than 28 days and will be subject ao ban on making further applications from outside the UK for at least a year.

OP - do you meet the rules for a fresh application? Do you have £5400 and can you get another CAS from your tier 4 sponsor?

My CAS letter is valid for six months although I can get a new one if I want to but I can not sort the funds out as it's too late plus dont have the money.

They have sent me a letter on 29 feb 2012 for refusal and stated i have the right to make a fresh application if I want or either leave the country with in 28days but according to my knowledge I was established student when I made my application and due to payment issue they did not consider my application until 9 of jan 2012 by this time I was out of leave.

you cannot use a CAS more than once. You will need another to make another application.

Your first attempted application was considered invalid, and therefore your subsequent applicaiton on 9th Jan considered out of time.

I would suggest seeking advice from the immigration advisors at your university.

I have contact a solicitor and they have advised me I can make a fresh application but I need to apply for PSW on 28 of march if i do that would my psw application considered to be valid.

on what basis are you applying for PSW and why did the solicitor advice you to apply on 28 march

No no my solicitor said apply for your T4 extension and in mean while we will submit another application for PSW I get my results on for my BSc degree.
