Wife's account for my son?

Post by jsn » Tue Mar 06, 2012 11:11 am

I need an advice, please. I am about to apply for Tier 2 General together with my wife and my baby son as dependants (we are all outside UK).

I have enough funds on my account for the required 90-days period only for myself (800 GBP). My wife has enough funds on her sole account for the same period for herself and my son (more than 2x 533=1066 GBP). If we apply for entry clearance together, can her bank statement cover funds for my son? (I've searched this forum and found some people saying that it is not possible, while others claimed it is.)

Appendix E of the Immigration laws states
(d) Where the applicant is applying as the Child of a Relevant Points Based System Migrant, the relevant amount of funds must be available to the applicant, the Relevant Points Based System Migrant, or the applicant's other parent who is Lawfully present in the UK or being granted entry clearance, or leave to enter or remain, at the same time.
However, the policy guidance for Tier 2 dependants states the acceptable evidence of funds is:
90. The documents required by Appendix E of the Immigration Rules are specified below.

i) Personal bank or building society statements covering the three month period immediately before the application. The personal bank or building society statements should clearly show:

- the name of the main applicant and/or the family member making the application, or (for children only) the name of the other parent who is also legally present in the United Kingdom;
Does "other parent who is also legally present in UK" also means a parent being granted entry clearance at the same time? I am bit confused here, as these two quotes seem to contradict each other.

Just to explain, we haven't put enough funds in my account only because I believed I could use my savings account for us all, but then realized by reading this forum that because of the notice period of few days it may not be acceptable by the UKBA.

Thanks in advance.
