Hi,
I Came to England on Tier 2 Visa on 27th-March-2006. In 2008-March , I got my Tier 1 & finally I got my UK ILR/PR on 1st- March-2011 .
All of my stay in UK was legal & my Stay out of UK during this Tenure was around 160 Days .
I left for India On 3rd-March-2011 for around 6 months and returned back to London on 17th-September-2011 .
So From 27th-March-2006 to 20th-Jan-2012 (till date) my stay out of UK is around 360 Days .
Keeping the above facts in mind ,When Can I apply for UK Citizenship at earliest ?
A bit more Clarification required regarding this . According to the Web Link:
The Residential requirement is as follows:
To demonstrate the residential requirements for naturalisation, you must have:
1.) been resident in the UK for at least five years (this is known as the residential qualifying period);
2.) been present in the UK five years before the date of your application; and
3.) not spent more than 450 days outside the UK during the five-year period; and
4.) not spent more than 90 days outside the UK in the last 12 months of the five-year period; and
5.) not been in breach of the Immigration Rules at any stage during the five-year period.
I am meeting all the Criteria on 1st-March-2012 except Point No 4 as I was out of UK for around 195 days (From 4th-March to 16th-Sept).
It means I can not apply on 01st-March-2012.Just need a bit more clarification regarding this.
Would it be fine if I apply on July 2012 because the Home Office will consider last 12 month after they recieve the application and in that case , I will be meeting this Criteria as well .
Appreciate if you can tell me the earliest date when I can apply to be successful ?
