Post by Raj422 » Wed Mar 07, 2012 4:53 pm

Hi,

I got my HSMP on 11th June 2007 and later extended ( Tier 1 ) in June 2009 till 6th June 2012. When is the earliest I can book for PEO.

Please advise.

Thanks

If you entered within 90 days of getting HSMP in 2007, you can apply 28 days before the 5th anniversary of your entry clearance.

Hi,

I have the same problem. I got HSMP visa on 13 Jun 2007 and entered UK on 18 July 2007.

By Jun 13 2012, when my Tier 1 extension expires, I will be 35 days short of 5 years.

In the UKBA document,

http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary

In Page 4 they say,
**************
Applications that fall short of the five year continuous period
In some cases, applicants may have been granted five years continuous leave, but due to
delayed travel will not have spent five years continuously in the UK before their current leave
expires. Caseworkers may count the period between entry clearance being granted and the
date the applicant entered the UK towards the five years, provided this period was not
longer than three months.
**************

Was any one successful in getting ILR with the above criteria. The thing that concerns me in the above para is "Caseworkers MAY count"; so is there a possibility "they might reject"?

Please advise...

Thanks

I have seen loads of people on this forum who have applied 28 days before the 5th anniversary of their EC date. I don’t think so any of us will have issue with it as HO seems to be giving discretion in every case I have heard of.

I am myself applying 28 days before my EC date in April.

Suravakonda you will be eligible to apply on or after Wednesday, 16 May 2012
