Hi,
I have the same problem. I got HSMP visa on 13 Jun 2007 and entered UK on 18 July 2007.
By Jun 13 2012, when my Tier 1 extension expires, I will be 35 days short of 5 years.
In the UKBA document,
http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary
In Page 4 they say,
**************
Applications that fall short of the five year continuous period
In some cases, applicants may have been granted five years continuous leave, but due to
delayed travel will not have spent five years continuously in the UK before their current leave
expires. Caseworkers may count the period between entry clearance being granted and the
date the applicant entered the UK towards the five years, provided this period was not
longer than three months.
**************
Was any one successful in getting ILR with the above criteria. The thing that concerns me in the above para is "Caseworkers MAY count"; so is there a possibility "they might reject"?
Please advise...
Thanks
